By purchasing, downloading, installing, activating, or using the Software, you agree to be legally bound by this Agreement.

If you do not agree, do not install or use the Software.

1. Ownership and Company Information

NxGen Addons For Elementor is a product brand of AF Digital Native, LLC (“Company,” “we,” “us,” or “our”).

All rights, title, and interest in and to the Software remain the exclusive property of AF Digital Native, LLC.

Your purchase grants a license to use the Software. It does not grant ownership.

2. License Grant

Subject to payment and compliance with this Agreement, Company grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software on WordPress websites according to your purchased subscription plan.

This license is granted per subscription terms and may be suspended or revoked for violation of this Agreement.

3. License Restrictions

You may not:

  • Resell, sublicense, or redistribute the Software

  • Share license keys beyond permitted usage limits

  • Reverse engineer or attempt to extract source code

  • Modify the Software for redistribution

  • Remove proprietary notices

  • Use the Software in violation of applicable law

Unauthorized use results in automatic termination of this license.

4. Nature of WordPress Software

You acknowledge and agree that:

  • WordPress environments vary widely in themes, plugins, hosting providers, PHP versions, and configurations.

  • Plugin conflicts may occur.

  • Updates to WordPress core, Elementor, themes, or third-party plugins may affect functionality.

  • Hosting providers may introduce changes that impact performance.

You are solely responsible for testing the Software in your environment.

We strongly recommend installing and testing on a staging site prior to deploying on a live website.

5. Use at Your Own Risk

The Software is provided strictly “AS IS” and “AS AVAILABLE.”

You assume all risk related to installation and use, including but not limited to:

  • Website downtime

  • Data corruption or data loss

  • Layout or design changes

  • Plugin or theme conflicts

  • Hosting instability

  • Security vulnerabilities

  • SEO performance changes

  • Business interruption

  • Loss of revenue or profits

You are solely responsible for maintaining complete website backups before installation, updates, or configuration changes.

6. No Warranties

To the fullest extent permitted by law, Company disclaims all warranties, express or implied, including:

  • Merchantability

  • Fitness for a particular purpose

  • Non-infringement

  • Compatibility with specific themes or hosting providers

  • Uninterrupted or error-free operation

We do not guarantee that defects will be corrected.

7. Limitation of Liability

To the maximum extent permitted by law, AF Digital Native, LLC shall not be liable for:

  • Indirect damages

  • Incidental damages

  • Consequential damages

  • Loss of revenue

  • Loss of profits

  • Loss of data

  • Business interruption

  • Reputational harm

Total aggregate liability under this Agreement shall not exceed the amount paid for the Software in the twelve (12) months preceding the claim.

This limitation applies regardless of the legal theory asserted.

8. Subscription Terms and Billing

The Software is offered on a recurring annual subscription basis unless otherwise stated.

By purchasing, you authorize automatic renewal at the then-current renewal rate using your payment method on file.

Account Dashboard

You may manage your subscription, billing information, license keys, renewal status, and cancellations through your customer dashboard:

It is your responsibility to:

  • Monitor your renewal date

  • Cancel prior to renewal if you do not wish to continue

  • Maintain accurate billing information

Cancellation must occur before the renewal date to avoid renewal charges.

Pricing Changes

Company reserves the right to modify subscription pricing at any time.

If pricing changes apply to your subscription:

  • The new rate will apply at your next renewal date.

  • Continued use after renewal constitutes acceptance of the updated pricing.

  • If you do not agree to a pricing change, you must cancel before renewal.

Failure to cancel prior to renewal authorizes the renewal charge.

Failed Payments

If renewal payment fails:

  • License access may be suspended

  • Updates and support may be restricted

  • Continued non-payment may result in termination

Chargebacks

Initiating a chargeback without first contacting support to resolve the issue may result in:

  • Immediate license suspension

  • Termination of access

  • Revocation of active licenses

9. Support

Support is provided on a best-effort basis according to your purchased plan.

Support does not include:

  • Debugging third-party plugins or themes

  • Custom development

  • Server configuration

  • Emergency site recovery

No guarantee of resolution is provided.

10. Third-Party Dependencies

The Software depends on:

  • WordPress core

  • Elementor

  • Third-party themes and plugins

Company is not responsible for:

  • Changes made by Elementor

  • Changes made by WordPress

  • Changes made by hosting providers

  • Third-party plugin conflicts

11. Termination

Company may suspend or terminate your license for:

  • Violation of this Agreement

  • Fraudulent activity

  • Unauthorized redistribution

Upon termination, you must cease use and delete all copies of the Software.

12. Indemnification

You agree to indemnify and hold harmless AF Digital Native, LLC from any claims, losses, liabilities, or legal expenses arising from:

  • Your use or misuse of the Software

  • Your website content

  • Your violation of this Agreement

13. Force Majeure

Company shall not be liable for failure or delay caused by events beyond reasonable control, including server outages, cyberattacks, internet disruptions, or governmental actions.

14. Governing Law

This Agreement shall be governed by the laws of the Commonwealth of Virginia.

Any disputes shall be resolved in state or federal courts located in Virginia.

You waive participation in any class action against Company.

15. Entire Agreement

This Agreement constitutes the entire agreement between you and AF Digital Native, LLC regarding the Software.
